Terms of Service

Sketch AI (“we,” “our,” or “us”) provides the mobile application “Sketch AI” (the “App”). Please read these Terms of Service (“Terms”) carefully before using the App.

1. Acceptance of Terms

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the App.

2. Use of the App

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you are at least 13 years of age.

3. Account Registration

To access certain features of the App, you may be required to register for an account using Google Sign-In. You agree to keep your password confidential and will be responsible for all use of your account and password.

4. User Content

  • Your Sketches: You retain all ownership rights to the sketches and drawings you create using the App.
  • Generated Content: You retain ownership rights to the images generated by our AI services based on your sketches, subject to the terms of the underlying AI provider (Google Gemini).
  • License to Us: By using the AI generation feature, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content solely for the purpose of operating, developing, providing, and improving the App and our services.

5. Prohibited Conduct

You agree not to use the App to:

  • Generate or upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another’s privacy.
  • Engage in any activity that interferes with or disrupts the App or the servers and networks connected to the App.
  • Attempt to circumvent any content filtering techniques we employ (including NSFW detection via TensorFlow Lite).
  • Use the App for any illegal or unauthorized purpose.

6. AI Generation Disclaimer

The App utilizes Google Gemini AI technology to generate images based on your sketches.

  • Accuracy: AI-generated content may not always be accurate or appropriate.
  • Uniqueness: Generated images may not be unique and other users may generate similar images.
  • Availability: We do not guarantee that the AI generation service will be available at all times.
  • Storage: Generated images are stored on our servers for a limited time (24 hours) and then automatically deleted. You are responsible for saving generated images locally to your device.

7. Subscription Services

The App offers premium features through subscription plans managed via RevenueCat.

  • Billing: Subscriptions are billed in advance on a recurring basis.
  • Cancellation: You may cancel your subscription at any time through your Google Play Store account settings.
  • Refunds: Refunds are handled by Google Play Store in accordance with their refund policy.
  • Changes: We reserve the right to change subscription fees at any time.

8. Intellectual Property

The App and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of GZLL Studio and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries.

9. Disclaimer of Warranties

The App is provided on an “AS IS” and “AS AVAILABLE” basis. The App is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

10. Limitation of Liability

In no event shall GZLL Studio, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

12. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
